Giving away property while you're alive is very different from other probate-avoidance strategies, which all involve leaving things to people at your death. Making gifts help you avoid probate for a very simple reason; if you don't own it when you die, it doesn't have to go through probate. That lowers probate costs because, as a general rule, the higher the monetary value of the assets that go through probate, the higher the expense. All you need to make a gift is a check book: no fancy documents (or legal fees) are required. But if you're feeling especially generous, you should know that if you make gifts of more than $10,000 per reipients in a calendar year, you could be liable for federal gift tax. |

What happens if you die without a will? Abraham Lincoln did it. Pablo Picasso did it. So did Howard Hughes. All these famous people died without a valid will leaving relatives and lawyers to wrestle over their estates. Well, they were busy. What's your excuse? Most people without wills simply haven't gotten around to the task; its not something that many of us happily put on the top of our "to do" lists.
